This is an outstanding summary of Special Needs Trusts creation and administration for the California resident.The Rules for SSI and MediCare once made sense, but through the years they have been changed, and twisted to the point they create a minefield of potential catastrophic errors for those wishing to care for those who cannot take care of themselves.Of you have substantial assets to place into a Special Needs Trust, go see a legal specialist, BUT first read this book so that you will fully understand the bizarre system we have created in the US for taking care of our damaged children.If the assets are small, then this book should allow you to set up and administer the trust yourself with the help of others.I cannot recommend this book too much. Its great.
Excellent, excellent, excellent! Recommended by an estate lawyer - especially the entire chapter on why you should *not* be a Special Needs Trust trustee - truly a minefield, *extremely* easy to make mistakes, and unlimited personal liability (there is no such thing as a bond for "errors and omissions for a Special Needs Trust trustee). This book is the very best advice I got from my surprisingly poor lawyer. So the Special Needs Trust which I was going to administer I am now happily handing off to a professional fiduciary/trustee.
This book saved me, with my Trust, a Special needs Trust, from undue cruelty from un-informed $400 / hourattorney's directives to the Trustee and Fiduciary on how to administer.Within 1 month after the Fiduciary heard from me about the "book", and the Trustee and Fiduciary acquired the BOOK,everything in my miserable life changed for the better, as Knowledge trumps idiots beliefs untilKnowledge is found. Many fools have fools for an attorney, I was not able to select the attorney, northe trustee, but I did "hire" the Fiduciary as the Trustee, when the Trustee decided to quit, post BOOK.Buy the book and then interview the legal people and see if they have a clue. It is your "loved" oneslives at stake.I ordered the Book Sometime in January 2012, A best move on my part.
This book is not an easy read for a layman, but it is essential to understand what my lawyers and the trustee must do for the person with the Special Needs. I'm finding it very informative. It was recommended as the "go to" source, by someone in the know. Highly recommend.
This book has been very helpful in getting a handle on special needs trust administration.
if you need to know this specialized thing, this book is excellent. you do still need an attorney and accountant, but at least you have some chance of understanding and reviewing what these experts are telling you. It only applies to California and the Affordable Care Act has changed some stuff already (this is from 2011).
This is a great guide to give clients who are thinking of setting up a Special Needs Trust as well as for those who are undertaking to act as trustees of such trust. In my experience as an Estate Planning Attorney for over 26 years, people are often unprepared for what they need to know to act as trustee of these trusts. It is wonderful to have a resource to give them, at least for California SNTs.
